take it away. >> reporter: the local head of the atf, the federal agency tell it, they believe this person of interest is the person who threw the bottle of what smelled like gasoline into the food court here around noon today. and this person was found east of here in front a cheesecake factory and that was about 2:30. about an hour later, they brought them to the arlington county police station where he's now. he's not charged and, again, police and federal agents believe this is the guy. can you look behind me. the mall is open and the fbi and atf investigators are still here. arlington county fire officials say whatever it was not hazardous he targeted a food court in a mall at lunchtime. just after noon today on boston common mall on wilson boulevard in arlington. county police and fire, fbi and atf agents working together on a case that didn't force a

mallwide evacuation. some businesses remained open, but anyone who left the mall when police arriv was not allowed back in. >> at this point, the task force indicated they're going to take the investigation from the arlington county police department. we'll be assisting in that matter. >> reporter: officials are quick to point out they're not calling this a terrorist attack. these photos from inside the mall from our friends at arlington now show you the scene of the crime. witnesses are telling investigators a man threw a 40- ounce beer bottle with a lit fuse and a liquid that smelled like gasoline into the food court from an upper floor. the liquid did not ignite or explode. >> during the course of the subject, similar bottles were found on the property matching the one that was dropped by the suspect. >> reporter: arlington police say what appeared to be three additional molotov cocktails were found in a bag on the

second floor of the mall. again, within the last couple of hours, a person of interest who, according to atf agents s probably the guy they were looking for, a lookout was put out. african-american male, curly hair, a red tie with one of the lookouts. we believe that police and some citizens who heard that lookout will, were able to identify the guy again and east of here at the cheesecake fact or, we don't know what it was about, but the mall is reopened. >> thank you for the update, bob barnard. new details on the arrest of an accused terror suspect in new york. 21-year-old quazi nafis was caught in an undercover fbi sting. he was stopped yesterday as he tried to detonate a car bomb outside of the federal reserve building in new york city. the bomb was fake because the people he thought were helping them were undercover agents. we learned he considered targeting president obama or the new york stock exchange. the father said he is shocked

by his son's arrest. this is what we understand from a law enforcement source happened after lunch today. there were a number of meetings between the prosecution, the defense, and the judge. the reason being, a local reporter decided to look into the background of judge beverly woodard and discovered that several years ago she was married to a police officer who had been convicted of excessive force. the reporter wanted to know why the judge had not recused herself since this is a trial about excessive force. the judge then asked for a meeting with the prosecution and the defense. according to the source, there was a meeting in the judge's chambers. this lasted for quite some time after the lunch hour. we understand from our source that the judge said she didn't want to recuse herself. she felt she could be a fair and impartial, the defense didn't want a mistrial, and the prosecution felt that if they accepted a mistrial, then there could be double jeopardy and they would not be able to retry

the officers. at this hour, the trial will continue tomorrow with closing arguments. now, earlier today, the codefendant in this case, james harrison, took the stand in his own defense. under questioning from his defense attorney, officer james harrison said he first saw john mckenna about 45 seconds before his codefendant, officer reginald baker, hit the student with his shield sending him into a wall. harrison told the court he saw mckenna hit bake or his helmet while holding a cell phone in his hand. he was concerned about the cell phone because he had received bulletins saying that firearms could be disguised as cell phones. harrison said he told mckenna to drop it and hit him seven to eight times. did you strike him in the head, asked the defense attorney. harrison replied never. when asked by prosecutor joseph ruddy why he lived to internal affairs claiming he was not one of the striking officers seen in the video, harrison replied it was for financial reasons. he's the father of eight

children, and the sole bread winner in the family, and he was afraid of losing his job. officer harrison also added that he had heard on the news that chief roberto hilton, the chief at the time, was going to fire any officer who took part in that beating. there was no mention in this trial about john mckenna having a cell phone in his hand. that was another a part that was brought out in croaks because -- cross examination, no one mentioned, not even john mckenna mentioned there was a cell phone in his hand. this was the first time they heard mckenna had a cell phone in his hand and that is why harrison felt he needed to go in with a baton. another note, harrison didn't report the use of force. he said he thought his supervisors were going to do it. will. >> paul, really quickly here, in your opinion based on what is happening with the judge, do you think there is an avenue now for an appeal, depending on

who doesn't like the outcome? >> reporter: well, i sat through a lot of the trials before. usually this stuff has to be set in open court, will, and on the record. none of this was done on the record. it was all behind the scenes. that is why we reported it through sources. >> all right, paul wagner with the update. thank you, paul. to another news alert. this is out of howard county. the police are asking for your help finding a man accused of secretly videotaping two women inside their home. look at the video. the police say this is the suspect setting up the hidden camera inside the ellicott city home. they don't know who the man is or how he got inside. investigators say he entered the condo several times to move the camera around. if you recognize the man, police would like to hear from you. another big story tonight, police in northern virginia announcing the results of a major crackdown along the richmond highway chord door. the 10-month operation netted more than 100 arrests. karen gray houston is live in fairfax county with the latest.

karen. >> reporter: shawn, we're talking about an operation that started in january. police say that they seized, altogether, 10 pounds of cocaine, 30 pounds of marijuana, 23 guns, two bulletproof vests, and $560,000 in cash. at least 30 of the arrests were made today and the sweep included a search warrant executed at this dollar depot on richmond highway in fairfax where police were investigating count fitting of dvds, cds, handbags, and other merchandise. fairfax county police teamed up with police from prince william county and the virginia state's police. the joint criminal intelligence team targeted what they called problematic areas along the richmond highway stretching from fairfax into prince williams. stolen property seized, included electronics, jewelry, credit cards. they also confiscated a large

quantity of prescriptions and non-prescription drugs. >> the same individuals that were committing crimes in prince william county were the same individuals that were committing crimes, obviously n fairfax county. obviously, you know, the criminals don't respect the boundaries. just like the police would, if we had jurisdiction. >> this has been a lengthy investigation, it used ingenuity, a mix of traditional and non-traditional tactics and i commend how much they cared and how much they sought to arrest that guy, arrest the offenders and keep our communities, our collective communities. >> reporter: now, that attempted murder-for-hire plot that we motioned involved a prince william -- mentioned involved a prince william county man asking him to kill his wife. and, by the way, the end of the police operation leaves the fairfax county police chief, david rorer, going out with a big bang. he's finishing up his term as fairfax county. the police chief tomorrow stepped into the new job next week as fairfax county deputy

bagged salad. try to buy it with as a sell by date as long and the future possible. that means can you take it home and put it in their refrigerator and that might be good for a longer period of time. >> and sell -- >> and sell by/use by is not a myth. these states do matter. sometimes we take them too literally. the reality is that american families talk more than -- toss more than 120 pounds of food each month. more often than not, it's because the product is past the used by date. it doesn't mean it's bad but not as fresh. when it comes to your food shelf life, eggs can last weeks past the use by date as long as they're stored in their original packaging. cheeses, hard cheeses can last months and canned goods, years. cold cuts last one week past the use by date and frozen raw meat whole not ground is typically edible about 12 months past the expiration date. frozen ground beef will hold for about three months. but the same time -- about the same time can you keep ice

people against gay marriage in maryland are using the suspension of an administration official at gallaudet university to promote their side of the issue and they're doing it with a new tv ad. that commercial is drawing fire from both the university ands suspended employee's lawyer. john henrehan has more. >> reporter: angela mccaskill has been an administrator at gallaudet for 23 years. the chief diverse officer at the d.c.-based college was suspended from her job for signing a petition that will allow maryland voters to decide whether to afirm the legislator's decision to legalize gay marriage. to her surprise, she's the star of a tv ad by a group oppose

error-- opposed to gay marriage. this is part of the commercial. >> reporter: dr -- . >> dr. angela mccaskill is an official at gallaudet university. she signed a pension putting question six on the ballot and was suspended by her job. she's not alone. people who believe in traditional marriage have been punished. >> reporter: the group running the ad is the maryland marriage alliance. they believe the mccaskill case illustrates the intolerance for their views. >> millions of people believe that marriage is between one man and one woman and we're threatened in terms of what we think and our religious freedoms and liberty, freedom of speech and those are critical issues. >> reporter: the main group supporting gay marriage criticized gallaudet university for suspending dr. mccaskill. marylanders for marriage equality believes the new ad is deceptive. >> the battle language says clearly that when marylanders go to the polls, it will read

religious prime is protected, religious beliefs are protected, no clergy has to marry anyone they don't want to, and this is about civil marriage licenses for gay-and- lesbian couples to go to the courthouse to get a marriage license. >> reporter: mccaskill's attorney said she did not approve or cooperate in the making of the commercial, and the suspended academe sick remaining publicly neutral on question 6. the commercial was made with footage that gallaudet posted on the internet. the university is asking the video be removed from the commercial. one final point, dr. mccaskill's attorney, jay wendell gordon, told me this afternoon that he's begun a negotiation with gallaudet for her to return to her side and -- job and they're getting closer. that is where the story stands. >> thanks for the update. staying on gay marriage, a divided federal appeals court in manhattan struck down a law that defines marriage between a man and woman.

clock is ticking for the presidential candidates. we're less than three weeks for the election. >> two debates down and one to go. wisdom martin has this week's campaigu. >> reporter: we're here with the professor and we're talking about what happened with the debate. first of all, let's talk about what just happened in the debate. winners, losers, your opinion with about what happened, right? >> first some context. >> uh. >> we're dealing with the after math of the first debate where mitt romney was seen as the big winner. that raises enthusiasm level, got a lot of people energized in the republican party, and we're seeing that reflected in the polls. currently, romney leading the country in some polls. not all of them. the president is still ahead in others. the battleground states are closing and he's pulling ahead in some key states and this is going to be a very tight race and we had the first debate and

the vice presidential debate and the second presidential debate. >> and president obama is widely considered the narrow winner and per important than who won or lost, a lot of media consumes, the mistakes that mitt romney made and the so- called binders of women, not a mistake per say but created a lot of controversy toward his views of women and to the comments at the end on libya and where candy crowley corrected him on a particular fact. that created a lot of controversy, too. the press is focusing on these. we do see greater enthusiasm from the democrats after the debate and the question is, will that begin to even up the polls again and move o bam bama ahead? >> and the next debate coming up, what do we expect to see from this next debate? >> foreign policy debate. and that had been considered

the president's area and not mitt romney's. there is iran, china, middle east peace -- there is going to be a lot of tense issues coming up, and we'll have to see if the president does is going to be able to reassert his command in the authority on that and if mitt romney can score points. mitt romney has to score the command as well and that is a test of how he can become the commander in chief. >> and let's get some of the opinions from the students about what they have seen so far. what did you think about the latest debate? >> i thought the debate was interesting and more entertaining and aggressive than the last debate. and obama did a great job attacking romney and in areas, but romney did a good job and that is still a tossup. >> it will be interesting to see if obama coming out is enough to change the narrative and. >> i think it was important for president obama to have this

coming on up. farther to the west, way out to the west is where we have had some thunderstorms and some severe weather this afternoon and this evening. we so some severe thunderstorms right now into west virginia and that will stay away and when the thunderstorms come across overnight tonight, doesn't look like it's going to be severe. the rain into spotsylvania county, eventually through fredericksburg and to the north along i-95 and this is going to be the first batch in metro, and i think this is going to be more widespread again and in through the evening hours. a strong flow from the south, showers breaking out. thunderstorms are father to the west ahead of the frontal system which, is slowly moving in our direction, and i wanted to pull this out because you can see this storm engine cranking over the midwest and this will usher in some slightly colder air as we start going into the weekend and that
